The ifi-Institute, as the content provider, is responsible for its own contents that are provided by us according to the common law. It is essential to differ between the content provided by the ifi-Institute and contents that are provided by others available by “links”. By links we provide foreign contents for use. We are only responsible for any foreign contents (i.e. even of any illegal and criminal content), if we have any positive acknowledgment of them and it is technically possible and reasonable to prevent their use (§5 Abs.2 TDG).
“Links” are always “living” (dynamic) referrals. Although we have verified the foreign contents at first connection in order to ensure that no possible responsibilities are caused by civil law or criminal law, we, as the content-provider (TDG), are not bound to verify the contents continuously; we link for any changes that could cause a new responsibility. Only if we note or are shown an explicit offer, we provide an existing link to and which causes any responsiblities by civil or criminal law, we will cancel the link to this offer as far as technically possible and reasonable for us. The technical possibility and reasonability is not influenced in a way that after the disconnection to the offer by the ifi-Institute, it is not possible to gain access to illegal or criminal content by different servers.
